1. Operator and contact

Noteish is operated by Magdaléna Hlohovská. Questions about these terms, the website, or Noteish support can be sent to support@noteish.app.

2. Scope and acceptance

These terms apply to your use of noteish.app and to the direct-download version of Noteish, except where a separate agreement or mandatory law applies. By using the website or downloading and using the direct-download app, you agree to these terms. If you do not agree, do not use the website or software.

When available, the paid Mac App Store version will also be subject to Apple’s applicable terms and the license agreement presented by Apple.

3. Website use

You may browse the website and use its information for lawful, personal, and informational purposes. You must not interfere with the website, attempt to gain unauthorized access, distribute malicious code, scrape it in a way that harms its operation, or use it to violate another person’s rights or applicable law.

4. Direct-download app license

Subject to these terms, Noteish grants you a limited, non-exclusive, non-transferable license to install and use the free direct-download version on a Mac that you own or control for personal or internal business use.

You may not sell, sublicense, rent, redistribute, or make the direct-download app available for simultaneous use by unrelated devices or users. You may not reverse engineer, decompile, or create derivative works except to the extent that applicable law expressly permits it or an open-source license requires it.

5. Mac App Store app

Apps distributed through the Mac App Store are licensed, not sold. When available, the App Store version of Noteish will be licensed under Apple’s Standard Licensed Application End User License Agreement unless a custom license agreement is later provided by the application provider.

These terms supplement that license only where they do not conflict with Apple’s agreement, Apple’s Media Services Terms, or mandatory consumer law. Apple may apply its own usage rules, platform requirements, updates, and service policies.

6. Pricing, payment, and refunds

The direct-download version is currently provided through the website at no charge. The planned Mac App Store version will be paid, but its price is TBA until the listing launches. Once available, the price shown by Apple at the time of purchase will control the transaction and may vary by country, currency, tax, or Apple’s pricing rules.

Apple processes App Store checkout, payment, delivery, and refund requests. Contact Apple through its support and refund channels for an App Store transaction. Nothing in these terms removes any statutory consumer guarantee, conformity remedy, or withdrawal right that cannot legally be excluded.

7. Your files and local content

Noteish is a local text editor. You remain responsible for the files, notes, copied text, and other content you open or create, including keeping backups appropriate for your needs. Do not use Noteish to store or process content that you are not entitled to access or edit.

8. Ownership and intellectual property

Noteish, its name, branding, software, website design, documentation, and other original materials are owned by or licensed to the application provider. These terms grant a right to use the software; they do not transfer ownership or intellectual-property rights to you.

9. Compatibility, updates, and support

Noteish is intended for macOS 15 or later. Features may change as macOS and Noteish develop. Updates may be supplied through the App Store or through later direct downloads. You are responsible for installing updates when appropriate for your system.

Support is provided through support@noteish.app. We will make reasonable efforts to respond, but support response times and continued availability are not guaranteed unless required by applicable law.

10. Availability and changes

We may maintain, update, suspend, or discontinue parts of the website or direct-download distribution. We may update these terms when the product, distribution channels, or legal requirements change. Changes apply prospectively from the revised effective date and do not remove rights that have already accrued or rights that cannot legally be waived.

11. Warranties and liability

We aim to provide Noteish as described on the website and in the relevant store listing. To the maximum extent permitted by law, the website and direct-download software are provided without guarantees that they will always be uninterrupted, error-free, or compatible with every system or file.

Nothing in these terms excludes or limits liability, warranties, guarantees, or remedies that cannot legally be excluded or limited, including mandatory consumer rights. Subject to that protection, we are not responsible for indirect or consequential loss arising from use of the website or software, including loss caused by failure to keep appropriate backups.

12. Termination

You may stop using the website or uninstall the direct-download app at any time. If you materially breach these terms, the license granted for the direct-download app may end and you must stop using it and remove your copies. App Store license termination is also governed by Apple’s applicable agreement.

13. Governing law and disputes

These terms are governed by the law of Slovakia, without depriving consumers of mandatory protections or forums available under the law of their usual place of residence. Consumers should first contact us at support@noteish.app so we can try to resolve a complaint.

Where applicable, a consumer may use an eligible alternative-dispute-resolution body in their country. Slovak consumers may consult the current list of bodies maintained by the Slovak Ministry of Economy. We do not include a link to the discontinued EU Online Dispute Resolution platform.
